DCP’s permission to file molestation, Pocso case; big decision of Mumbai CP

Mumbai Police Commissioner has taken a big decision regarding Pocso. From now on, the permission of DCP level officer (DCP) will have to be sought before filing a case of Pocso or Molestation. Mumbai Police Commissioner Sanjay Pandey has taken this decision.

Mumbai Police Commissioner Sanjay Pandey recently issued an order stating that complaints of pocso or molestation have been lodged in the police station due to old disputes, property disputes or any other animosity. In such a case, the accused is often acquitted, but by then it is too late and he is also defamed.

In cases related to matrimonial disputes, a preliminary inquiry must be conducted before the FIR is filed : HC

The High Court of Jammu and Kashmir recently comprising of a bench of Justice Vinod Chatterji Koul observed that in Matrimonial or family disputes, a preliminary enquiry must be conducted before the FIR is filed to determine whether a cognizable offence has been committed while safeguarding the rights of the complainant and accused.
